According to 11-1051 they can only do that when they have "received verification" that the person is an alien. Is there another section which deals with detainment during "stops"?

In addition, Section F of 13-1509, the willful failure to carry/complete passage, states that a person "who has authorization" to be in the US is not in violation of the section, which in my eyes means that even if I don't have my documentation with me, I do not violate the state law as long as I simply have the papers at my home (even though I am still in violation of US statutes requiring 18+ aliens to carry documentation).

oallen@kvoa.com - webmaster for Tucson, AZ TV station.Unknownhttps://www.blogger.com/profile/02107770654499869982noreply@blogger.comtag:blogger.com,1999:blog-2344584665386017340.post-25762199080310727552010-05-05T14:35:37.093-07:002010-05-05T14:35:37.093-07:00RumpledOne: You ought to read 8 USC 1325 - it doe...RumpledOne: You ought to read 8 USC 1325 - it doesn't really say what you think it says. Under Arizona SB 1070, one can be detained even if they are not in violation of 8 USC 1325. But thanks for the comment.Jay Reisingerhttps://www.blogger.com/profile/14168647054373577608noreply@blogger.comtag:blogger.com,1999:blog-2344584665386017340.post-51028152201242373492010-05-05T13:51:02.746-07:002010-05-05T13:51:02.746-07:00Is the US CODE UNCONSTITUTIONAL?
US CODE TITLE 8 ...Is the US CODE UNCONSTITUTIONAL?

US CODE TITLE 8 > CHAPTER 12 > SUBCHAPTER II > Part VIII > § 1325

§ 1325. Improper entry by alien

TITLE 8 > CHAPTER 12 > SUBCHAPTER II > Part VIII > § 1324a

§ 1324a. Unlawful employment of aliens

WE DO NOT NEED IMMIGRATION REFORM. WE NEED IMMIGRATION ENFORCEMENT.

ENFORCE THE LAW

We should treat immigrants like Mexico does:

At present, Article 67 of Mexico's Population Law says, "Authorities, whether federal, state or municipal ... are required to demand that foreigners prove their legal presence in the country, before attending to any issues."

That would simplify things.TheRumpledOnehttps://www.blogger.com/profile/06155926996925747561noreply@blogger.com
